CLOUD Act

The CLOUD Act (Clarifying Lawful Overseas Use of Data Act, 18 U.S.C. § 2713, signed into law March 23, 2018) is a United States federal statute that authorizes US courts to compel US-based electronic communication service providers and remote computing service providers to disclose data stored outside the United States in response to a valid US legal process — regardless of where the data physically resides. Why it reversed prior precedent

Before the CLOUD Act, a 2016 Second Circuit Court of Appeals ruling had held that the US government could not compel Microsoft to produce emails stored on servers in Ireland. The CLOUD Act reversed that precedent at the statutory level: physical storage location is no longer a reliable shield if your service provider is headquartered in the United States, incorporated under US law, or delivers services through US entities. Major cloud hyperscalers — AWS, Azure, Google Cloud, and others — fall within the statute's reach regardless of which regional availability zone stores your data.
